In brief

  • RoomMe helps people make introductions; it does not guarantee a match, a person, or a living situation.
  • You make your own calls about meeting, messaging, sharing information, money, tours, leases, and housing.
  • Use RoomMe honestly, safely, and without unlawful discrimination or harassment.

These Terms & Conditions (the Terms) govern your access to and use of RoomMe's websites, applications, and related services that link to these Terms (together, the Services). By creating an account, downloading an application, or otherwise using the Services, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Services.

1. What RoomMe does—and does not do

RoomMe provides tools intended to help adults create profiles, understand lifestyle preferences, discover potential roommate connections, and start conversations. RoomMe is not a landlord, property manager, real-estate broker, tenant-screening agency, credit-reporting agency, employer, guarantor, insurer, or party to any lease, payment, deposit, property tour, or agreement between users unless we expressly say so in separate written terms.

Compatibility, mutual-connection, profile, and trust-related features are informational. They are not endorsements, recommendations, guarantees, background checks, identity verification, criminal-history checks, credit checks, or a promise that any person is safe, suitable, available, or compatible. Unless RoomMe expressly states that a specific feature includes a particular verification or screening process, you should assume it does not.

2. Eligibility and accounts

You must be at least 18 years old and able to enter into a binding contract to use the Services. You represent that the information you provide is accurate, current, and complete, and that you will keep it updated.

You are responsible for safeguarding your account credentials and for activity that occurs through your account. Tell us promptly if you believe someone has accessed your account without permission. We may require identity or account verification before acting on certain requests.

3. Your profile, content, and privacy choices

You control the content you submit, including photos, bios, preferences, messages, and social links. You are responsible for deciding what to share and for ensuring that you have the right to share it. Do not post information that you would not want a potential roommate, or someone who receives a screenshot, to see.

You retain ownership of your content. To operate and improve the Services, you grant RoomMe a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, display, distribute, and otherwise use your content solely to provide, maintain, secure, and improve the Services, and to meet legal obligations. That license ends when you delete the content or close the account, except to the extent we need to retain it for backups, legal obligations, dispute resolution, security, or enforcement.

If you send us ideas, suggestions, or feedback, you give us the right to use them without restriction or compensation to you.

4. Safety, meetings, housing, and money

You decide whether, when, and where to communicate or meet someone. Use good judgment: keep personal details private until you are comfortable, meet in a public place where appropriate, tell someone you trust about plans, and leave any situation that feels unsafe. RoomMe does not supervise meetings or communications between users and is not responsible for actions users take online or offline.

You are solely responsible for evaluating a potential roommate, property, lease, payment, deposit, and housing arrangement. Consider independent references, verification, legal advice, and any screening that is appropriate to your situation. Never send money or sensitive information to someone you do not trust. RoomMe does not process, hold, or guarantee payments between users unless a specific feature clearly says otherwise.

5. Respectful and lawful use

You may not use the Services to:

  • Impersonate another person, create a false or misleading profile, or misrepresent a connection, property, or intent.
  • Harass, threaten, exploit, stalk, defraud, discriminate against, or harm another person.
  • Post or transmit unlawful, infringing, hateful, sexually exploitative, defamatory, invasive, or otherwise objectionable content.
  • Collect, scrape, harvest, sell, or misuse other users' information, including profile information, contacts, or messages.
  • Use the Services to advertise, select, exclude, or treat people differently in violation of applicable housing, civil-rights, or anti-discrimination laws.
  • Send spam, malware, unsolicited commercial communications, or use automated means to access the Services without our written permission.
  • Interfere with the Services, bypass security, probe or test vulnerabilities, or access information or accounts without authorization.

We may investigate suspected violations and remove content, restrict features, suspend, or terminate accounts when we reasonably believe it is necessary to protect users, RoomMe, or the Services, or to enforce these Terms. We do not have an obligation to monitor every interaction or piece of content.

6. Third-party services and purchases

The Services may link to or rely on app stores, social platforms, payment processors, subscription providers, maps, and other third parties. Your use of them is governed by their terms and privacy policies, not these Terms. RoomMe is not responsible for third-party services, content, availability, or actions.

Paid features, subscriptions, and in-app purchases may be subject to additional terms shown at purchase. If you purchase through an app store, that store's billing, cancellation, and refund rules apply unless applicable law requires otherwise.

7. Intellectual property

RoomMe and its licensors own the Services, including software, design, branding, content, and other intellectual-property rights, except for content owned by users. Subject to these Terms, RoomMe gives you a limited, personal, revocable, non-transferable, non-sublicensable license to use the Services for their intended purpose. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the Services except where applicable law does not allow us to restrict that activity.

8. Service changes and availability

We may change, suspend, or discontinue any part of the Services, including features, content, eligibility requirements, or availability, at any time. We will use reasonable efforts to give notice of material changes when appropriate, but we do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

9. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ROOMME DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND SECURITY. ROOMME DOES NOT WARRANT THAT ANY USER, PROFILE, PROPERTY, CONNECTION, OR COMPATIBILITY SIGNAL IS ACCURATE, COMPLETE, SAFE, SUITABLE, OR AVAILABLE.

Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ROOMME AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, ROOMME'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ROOMME FOR THE RELEVANT SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Nothing in these Terms limits liability that cannot legally be limited. Some jurisdictions do not allow some limits of liability, so these limits may not apply to you.

11. Indemnification

To the extent permitted by law, you will defend, indemnify, and hold harmless RoomMe and its affiliates, officers, directors, employees, agents, licensors, and service providers from claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to your content, your use of the Services, your interactions or transactions with other users, or your violation of these Terms or applicable law. RoomMe may control the defense of a claim at its own expense, and you will cooperate with that defense.

12. Governing law and venue

Except where the law of your residence requires otherwise, these Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in New York County, New York, and you and RoomMe consent to that venue and personal jurisdiction. Nothing in this section limits rights that cannot be waived under applicable consumer-protection law.

13. Changes to these Terms

We may change these Terms as the Services or law evolve. If a change is material, we will provide notice as required by law. The revised Terms take effect on the date stated above or as otherwise communicated. If you continue to use the Services after they take effect, you agree to the revised Terms. If you do not agree, stop using the Services and close your account.

14. General terms and contact

These Terms, together with the Privacy Policy and any terms presented for a specific feature or purchase, are the entire agreement between you and RoomMe about the Services. If a provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; RoomMe may assign them as part of a merger, acquisition, or transfer of assets.

Questions about these Terms can be sent to roomme.contact@gmail.com.
